Rental Terms and Conditions – Fastcar Rent a Car

Fastcar Rent a Car (hereinafter, “Fastcar”) is an operating brand for vehicle rentals that operates within the offices of Plaza Rentalcar, the trade name of the Association of Rent-a-Car Companies of Ecuador (ASORENTCAR).

1. Definitions

• Customer: A natural or legal person who requests, reserves, contracts, or uses rental services.
• Reservation: A vehicle availability request made through any channel enabled by Fastcar.
• Rental contract: The document and/or digital acceptance applicable at the time of vehicle delivery.
• Official policies: The complete conditions published by Plaza Rentalcar, applicable to the rental.

2. Acceptance of the terms

By accessing, browsing, requesting a quote, or making a reservation on fastcar.com.ec (the “Site”), the Customer declares having read and understood these Terms and Conditions and agrees to be bound by them. Likewise, the Customer acknowledges and accepts that the rental contractual relationship is subject to the official policies of Plaza Rentalcar, which shall prevail in the event of any discrepancy.

3. Scope of service and Fastcar’s role

Fastcar acts as a commercial and customer service channel for managing quotes and reservations. The rental service is executed in accordance with unified standards and policies administered by Plaza Rentalcar, under the institutional framework of ASORENTCAR.

4. General delivery and return conditions

By way of example and without limitation, the Customer agrees that:

• The vehicle is delivered in proper operating condition and must be returned under the agreed conditions.
• The Customer is responsible for the proper use of the vehicle during the rental period, including its custody.
• Delivery/return conditions (including airport service) may vary by city and availability.
• Returns in a city different from the pickup location may be available, subject to availability and applicable conditions.

5. Insurance, guarantees, fines, fuel, and cleaning

The rental may be subject to coverage, deductibles, exclusions, guarantees, or deposits, as well as policies regarding fines, traffic violations, fuel, cleaning, and additional charges. These conditions are defined in the official policies and/or in the rental contract accepted at the time of vehicle delivery.

6. Payments, cancellations, and modifications

Payment methods, cancellation deadlines, penalties, refunds, no-shows, date/time/city changes, and any applicable financial conditions are governed by the official policies and by the reservation confirmation issued.

7. Accuracy of information and availability

Fastcar endeavors to ensure that the information on the Site is accurate; however, vehicle availability, rates, conditions, and benefits may vary by date, city, season, inventory, and operational validations. Reservations are subject to confirmation and verification of Customer requirements.

8. Customer requirements

The Customer must comply with the requirements demanded for the rental (e.g., minimum age, valid driver’s license, identification document, and required guarantees/payments), in accordance with the official policies and the rental contract. Failure to comply may prevent vehicle delivery, without prejudice to applicable penalties.

9. Limitation of liability

To the extent permitted by law, Fastcar shall not be liable for indirect, incidental, or consequential losses arising from the use of the Site or from events beyond reasonable control (including, but not limited to, force majeure, road closures, government orders, third-party delays, or communication failures). Liability applicable to the rental is governed by the official policies and the rental contract.

10. Third-party links

The Site may include links to third-party pages, including the Plaza Rentalcar website. Fastcar does not control such sites, and access to them is at the Customer’s own responsibility, without prejudice to Plaza Rentalcar being the primary legal source of the official policies.

11. Intellectual property

Texts, trademarks, logos, and other elements of the Site are the property of their respective owners and are protected by applicable law. Total or partial reproduction without express authorization is prohibited.

12. Data protection and communications

The processing of personal data and the sending of communications related to the reservation will be carried out in accordance with applicable regulations and the policies informed to the Customer during the contact and/or reservation process.

13. Amendments to these terms

Fastcar may update these Terms and Conditions to reflect operational or legal changes. The current version will be the one published on the Site and will take effect from its publication date, without prejudice to the prevalence of the official policies and the rental contract.

14. Applicable law and jurisdiction

For services provided in Ecuador, these Terms and Conditions are governed by the laws of the Republic of Ecuador. Any dispute shall be submitted to the competent courts of Ecuador, unless a mandatory rule provides otherwise. For services provided outside Ecuador, specific conditions may apply depending on the country of service, as informed to the Customer.
